Please read these Terms of Service ("Terms") carefully before using the KashBook mobile application and web application (collectively, the "Service"), operated by KashBook ("we", "us", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts and Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password and PIN that you use to access the Service and for any activities or actions under your password and PIN, whether your password and PIN is with our Service or a third-party service.

You agree not to disclose your password and PIN to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Subscription and Payments

KashBook offers both free and paid subscription plans ("Pro"). The Pro plan provides unlimited sales entries, unlimited inventory items, full reporting periods, product performance analytics, and CSV export functionality.

All payments are processed securely through Paystack. By subscribing to Pro, you authorize us to charge your selected payment method via Paystack. We do not store your full card details on our servers.

2.3 Billing and Renewal

Pro subscriptions are billed in advance on a monthly or yearly basis, depending on your selected plan. Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You can cancel your subscription at any time through the app settings.

2.4 Refunds

Due to the nature of digital services, all subscription fees are non-refundable except where required by Nigerian consumer protection law. If you believe you are entitled to a refund, please contact us within 7 days of the charge.

The free plan of KashBook includes the following limitations:

These limitations reset at the beginning of each calendar month. Exceeding these limits will require an upgrade to Pro to continue recording data.

4. Referral Program

KashBook offers a referral program where users can earn free Pro access by inviting others to use the Service.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of KashBook and its licensors. The Service is protected by copyright, trademark, and other laws of Nigeria and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of KashBook.

6. User Content and Data Ownership

You retain all rights to the data you enter into KashBook, including sales records, inventory data, business settings, and personal information ("Your Data"). We do not claim ownership over Your Data.

By using the Service, you grant us a limited license to store, process, and transmit Your Data solely for the purpose of providing and improving the Service. Your Data is stored in Google Firebase/Firestore and is encrypted in transit and at rest.

You are solely responsible for the accuracy and legality of Your Data. We are not responsible for any losses resulting from inaccurate data entry.

Data Export: Pro users can export their data as CSV files at any time. Free users may request a copy of their data by contacting us. We will provide your data within 14 days of receiving a verified request.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or use the "Delete Account" feature in the app settings. Deleting your account will permanently remove all Your Data from our servers within 30 days, except where we are required to retain data by law.

9. Limitation of Liability

In no event shall KashBook, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

KashBook is a tool to assist with business record-keeping. We do not provide financial, tax, or legal advice. You are responsible for verifying all calculations and complying with all applicable tax laws, including FIRS and state tax requirements in Nigeria.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

KashBook does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

While we strive to keep the Service available at all times, offline functionality depends on your device storage, and sync functionality depends on internet connectivity. We are not responsible for data loss due to device failure, loss, or lack of internet connectivity.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
